Remove Charge Offs

A charge off occurs when a consumer becomes severely delinquent on a debt. This quite often occurs after several months without payment, at which point the creditor declares the debt to be a charge off. When a creditor issues a charge off, it is added to the debtor's credit report. A charge off is one of the worst, if not the worst thing to have on your credit report.

When listed on your credit report, the charged-off item will include relevant dates, along with the amount of the bad debt. These uncollectable debts are considered a normal part of business for many banks and other creditors, but severally affect the credit of consumers that they are against.

A charge off is a debt that is deemed uncollectable, and written off. When a debt is charged off, it does not magically go away, but rather it is added to your credit report and then sold to a debt collector. Charged off means the debt is bad, and that the account is no longer open and active. The debt is still legally valid and claimable, and the creditor can attempt to collect the full amount either through their own internal collections staff, or more likely, an outside collection agency. A lawsuit is quite likely for charged off debts.

Even paying an old charge-off will not remove it from your credit reports, as it may simply be updated to a "Paid Charge-Off," which is slightly better but still horrible for your credit. The Fair Credit Reporting Act even states that a charge-off, paid or not, may remain on a consumer's credit report for up to seven years. The time limit is based on the date of the original delinquency (such as when the debtor missed a payment and never again became current), not the date of the last activity. So, paying off a charge off should not restart the seven year clock.

Some debtors may be able to negotiate with the creditor to have the charge-off removed from their credit reports in exchange for a partial or full payment, however, this does not always work out well. One of the best things to do for removing charge offs is to contact a credit repair attorney, such as Lexington Law Firm.
